Privacy Policy

Effective date: October 1, 2026. This policy replaces all earlier versions.

This Privacy Policy explains how EVA & JJJ, Inc., a California corporation that owns and operates RentalFacts.online (“RentalFacts.online,” “we,” “us,” or “our”), collects, uses, shares, protects, and keeps information when you use rentalfacts.online and its related services (the “Service”). It is part of our Terms of Service.

The short version. This summary is for convenience only. The full policy below controls.

  • We never sell, rent, or trade your personal information, and we do not use third-party advertising trackers.
  • Posting anonymously means anonymous to the public, not to us. We keep your identity private and generally require a court order before disclosing it (Section 7).
  • We strip hidden metadata, such as GPS location, from every photo, video, and document you upload, and we discard the original file (Section 5).
  • You decide, channel by channel, whether we may call, email, or text you, using our AI Compliance Shield (Section 9).
  • Listings and administrative records are permanent. Personal information linked to them is kept for five years (Section 11).

1. Who we are and what this policy covers

EVA & JJJ, Inc. decides how and why your personal information is processed on the Service. This policy applies to everyone who uses it: tenants, landlords and property managers, advertisers, people who send us requests, and visitors. It does not apply to other websites we link to, such as the legal aid organizations in our Tenant Help directory. Those sites have their own policies.

2. Information we collect

2.1 Information you give us

  • Tenants:
    • your name, email, phone, and address, required at registration even if you post anonymously;
    • listing content, such as the property address, owner or manager names, descriptions, categories, and dates;
    • photos, videos, and documents you upload;
    • your display choices and any resolution notes.
  • Landlords and property managers who file a dispute:
    • name, email, phone, and company name;
    • a verification document and a government ID image;
    • any response text or corrective media you submit.
  • Advertisers: name, company name, email, phone, billing address, ad creative, and subscription details.
  • People who send us requests: for content removal, copyright (DMCA), intimate-image (TAKE IT DOWN Act), or privacy requests, your name, contact information, signature, and whatever you include in the request.
  • Communication preferences and consent records:
    • your choices for each of the six channels in AI Compliance Shield (Section 9);
    • when and how you made each choice, the consent language you were shown, and the IP address used;
    • any later changes or opt-outs.
  • Communications: emails, calls, texts, and notes of your communications with us.

2.2 Information collected automatically

  • Server logs: IP address, browser and device type, pages requested, referring page, and timestamps, generated by normal web traffic.
  • Cookies: a session cookie that keeps you logged in and protects forms from cross-site request forgery (Section 10).
  • Analytics: page views, referring page, browser, device type, screen size, language, and approximate location, such as country or city. These are measured by analytics software we host ourselves, which does not use cookies.

2.3 Information from others

  • Other users. A tenant’s listing may include information about a landlord or property manager. A dispute may include information about a tenancy.
  • Stripe. We receive confirmation of your payment and limited card details, such as card brand and last four digits. We never receive your full card number.
  • Public records. We or our users may add property ownership information from public records, such as county assessor data.

2.4 Sensitive information

We collect government ID images only from people who file a dispute, and only to verify the dispute. We do not ask for health information. If you choose to include it in a listing, Section 13 applies. We do not collect precise geolocation from your device, and we remove location data from uploaded files (Section 5). Please do not include Social Security numbers, financial account numbers, or other sensitive details in listings or messages.

3. How we use information

We use personal information to:

  • operate the Service. That includes creating accounts, sending login codes, publishing listings according to your display choices, processing and scanning uploads, removing metadata, and translating content;
  • moderate content, enforce our Terms, review disputes, respond to removal requests, and prevent fraud, abuse, and security threats;
  • communicate with you according to your AI Compliance Shield choices, and send required service messages;
  • process payments and provide Featured placement and advertising services;
  • keep records needed for legal claims, including defending the Service and the listings our users post;
  • comply with the law and legal process, subject to Section 7; and
  • understand how the Service is used, in aggregate, so we can improve it.

We do not sell personal information. We do not use it for targeted advertising based on your activity across other websites. We do not use it for profiling that produces legal or similarly significant effects. We do not sell or license it to anyone for training artificial intelligence models.

4. What is shown publicly

Once a listing is published, the following are public:

  • its title, description, property address, owner or manager names, categories, and hashtags;
  • attached photos, videos, and documents;
  • its Resolved status and notes; and
  • its dispute status and any admin-written resolution summary.

Your name, phone, and email are shown on a listing only if you turn on each display option. They are off by default. Dispute materials are never shown publicly. That includes verification documents, ID images, response text, and corrective media. Only the admin-written resolution summary is published, once a dispute is resolved.

Masked display. Some pages, such as a status or confirmation page, show a masked version of your email or phone. It reflects the address or number on file when you submitted your original consent form or listing, not a live lookup, so it always matches the record that was actually collected.

Public means public. Search engines, AI answer engines, and other people can copy and index public pages. If you later hide your name or change a listing, we cannot recall copies made elsewhere.

5. Metadata scrubbing (EXIF data)

Photos, videos, and documents often carry hidden information called metadata. It can include GPS coordinates showing where a photo was taken, the date and time, the make, model, and serial number of the device, the software used, and a document author’s name.

What we do. When you upload a file, we automatically remove its embedded metadata before storing it:

  • Photos: EXIF, GPS, device, and similar data are removed. Photos are also converted to a web-optimized format such as WebP.
  • Videos: location, device, and creation-date metadata are removed.
  • Documents: author, organization, software, and revision metadata are removed.

We keep only the scrubbed version. The original file you uploaded is discarded after processing and is not kept.

What scrubbing cannot do. It does not change what can be seen or heard in your file. That includes faces, house or unit numbers, street signs, license plates, mail, reflections, text on screens, names or account numbers inside a document, and voices in a recording. Review your files and redact anything sensitive before you upload them.

Keep your originals. Because we do not keep your original files, keep your own copies, with their metadata, somewhere safe. The date, time, and location data in an original photo can help show when and where it was taken if you need it for a court case, a code-enforcement complaint, or a dispute. We cannot restore metadata we have removed.

6. How we share information

We do not sell, rent, or trade your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only in these situations:

  1. Publicly, at your direction. Listings and the details you choose to display are public (Section 4).
  2. Service providers. We use companies that process information for us under contract, only to provide their services to us and not for their own purposes:
    • web hosting and server infrastructure;
    • payment processing by Stripe;
    • machine translation by Microsoft, which receives only the text of content being translated and never account credentials or payment information; and
    • email, text-message, and voice delivery providers.
  3. Legal process and emergencies. Only as described in our Data Privacy Subpoena Defense (Section 7).
  4. Copyright and removal processes. If you send a copyright notice, we may forward it, including your name and contact information, to the user who posted the material. If you send a DMCA counter-notification, federal law requires us to forward it to the person who complained. It includes your name, address, and phone number, so it will reveal your identity to them (Terms, Section 11).
  5. Disputes. We tell a tenant when a dispute is filed about their listing. We do not give the disputing party the tenant’s identity or contact information, and we do not give the tenant the disputing party’s private materials.
  6. Business transfers. If EVA & JJJ, Inc. or RentalFacts.online is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred. It may go only to a successor that agrees to honor this policy, including Section 7, for information collected before the transfer.
  7. With your consent. When you ask us to share information, or agree that we may.
  8. De-identified or aggregate information. For example, counts of listings by city. This information cannot reasonably be used to identify you.

7. Data Privacy Subpoena Defense

RentalFacts.online exists so tenants can speak up without fear of retaliation. These rules govern requests for information that identifies a user, such as name, email, phone, address, IP address, or account records.

7.1 We do not voluntarily hand over identities

We will not voluntarily disclose information that identifies a user to a landlord, a property manager, their lawyers, or any other private party.

7.2 A court order is required

We disclose identifying information in response to a legal demand only when a court of competent jurisdiction has ordered it. Examples are a court order or a search warrant signed by a judge. A subpoena signed only by an attorney or a court clerk is not enough on its own. If we receive one, we will:

  • object to it;
  • ask the requesting party to obtain a court order; and
  • where appropriate, ask the court to quash or limit it.

We will not produce identifying information unless a court orders us to, or we are otherwise legally compelled after making reasonable objections.

7.3 We will tell you first

Unless the law prohibits it, such as under a court’s nondisclosure order, or an emergency prevents it, we will:

  • make reasonable efforts to notify you promptly, by email and through any transactional channels you have turned on, and send you a copy of the demand;
  • where timing allows, wait at least 14 days before producing anything, so you can get legal help and object or ask the court to quash it; and
  • point you to legal aid resources on our Tenant Help page.

This is one of the required legal-claim notices described in our Terms.

7.4 Protection for anonymous speech

Sometimes someone asks a court to reveal the identity of an anonymous poster, for example in a defamation case. In those cases, we will ask the court to apply the First Amendment standards many courts use to protect anonymous online speech. Those standards generally require notice to the poster and a showing that the claim has real merit before the poster’s identity is revealed. We will also object to overbroad requests, produce only the minimum information a court requires, and ask for confidentiality or protective orders where available.

7.5 Law enforcement

Government requests must meet the requirements of the federal Stored Communications Act and other applicable law. We require a search warrant or court order for identifying information and non-public content, unless we are otherwise legally compelled.

7.6 Emergencies

We may disclose information to law enforcement without a court order only if we believe in good faith that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay, as 18 U.S.C. § 2702 permits. Any such disclosure is limited to what the emergency requires, and we will notify you afterward unless the law prohibits it.

7.7 Preservation and our own defense

We may preserve records in response to a valid preservation request, such as under 18 U.S.C. § 2703(f). Preserving records is not disclosing them. If we are a party to a legal proceeding about content on the Service, we may use our records as needed to defend ourselves, under protective orders where available.

7.8 Limits

We cannot guarantee that a court will not order disclosure. This section does not protect information you choose to display publicly, or information you give to others yourself, including in a DMCA counter-notification (Section 6). Send legal process and inquiries to legal@rentalfacts.online and to our mailing address in Section 17, in addition to any service required by law.

8. Secure document storage

We protect uploaded files and personal information with these safeguards:

  • Encryption in transit. Every page, upload, and download on the Service uses HTTPS (TLS) encryption.
  • Storage outside the public web directory. Uploaded files are stored in a location that cannot be reached directly from the internet. Our application delivers a file only after checking that it is allowed to be seen. For example, a photo may be delivered because it is attached to a published listing.
  • Private materials stay private. Dispute materials, ID images, and verification documents are never delivered to the public. They are available only to authorized RentalFacts.online administrators, through the logged-in administrative system.
  • Malware scanning. Every upload is scanned for viruses and malicious code before it is stored. Infected files are rejected.
  • Metadata removal. Hidden metadata is removed from every upload (Section 5).
  • Limited access. Non-public information, such as your unmasked contact details, dispute materials, and communications, is visible only to RentalFacts.online administrators. They use it only as needed to operate the Service, review disputes, or respond to you.
  • Payment security. Card payments are handled by Stripe, a payment processor certified under the Payment Card Industry Data Security Standard (PCI DSS). We never receive or store full card numbers.

No website or storage system is completely secure, and we cannot guarantee absolute security. If a breach of our systems involves your personal information, we will notify you and any required authorities as required by Nevada law (NRS 603A.220) and other applicable state laws. You can help by keeping your email account and phone secure, since they are how you log in.

9. Communications consent: AI Compliance Shield (TCPA and CTIA)

We follow the Telephone Consumer Protection Act (TCPA) and the Federal Communications Commission’s rules, the CAN-SPAM Act, state telemarketing laws, and the CTIA Messaging Principles and Best Practices that mobile carriers require. We use a consent system called AI Compliance Shield.

9.1 Six separate choices

ChannelPromotional (marketing)Transactional (service)
Voice callsNews about tenant resources, site features, sponsors, and offersFollow-up about your listing, a dispute, or your account
EmailNewsletters, feature announcements, and offersListing status, moderation and dispute updates, and responses to your requests
Text (SMS/MMS)Tenant-resource alerts and offersListing and account alerts, and dispute updates

Each of the six channels is off until you turn it on. You may choose any combination, and you can change your choices at any time in your account settings. Changes take effect promptly.

9.2 How we get your consent

You give consent by an affirmative act, such as checking an unchecked box or switching on a toggle. This is separate from agreeing to our Terms. Before you consent, we show a clear disclosure that:

  • identifies RentalFacts.online and the channel;
  • explains that messages may be sent using automated technology, and that calls may use an artificial or AI-generated voice;
  • states that message frequency varies and that message and data rates may apply; and
  • explains how to opt out.

For promotional calls and texts, this is your prior express written consent under the TCPA, signed electronically under the E-SIGN Act. Consent is never a condition of using the Service or buying anything.

9.3 Required messages

Some messages are necessary and are not marketing:

  • One-time login and verification codes. We send these only when you request one, to the email or phone you choose at that moment.
  • Notices of legal claims. These tell you that a dispute, removal request, subpoena, or other legal claim has been made about content you posted.
  • Account-security and policy-change notices.

Required notices always go to your email. They go by text or voice only if you have turned on that transactional channel and not opted out of it. If you have replied STOP to our texts, choose email when you request a login code.

9.4 Text-message details

  • Message frequency varies. Message and data rates may apply.
  • Reply HELP for help, or contact support@rentalfacts.online or (844) 787-7799.
  • Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPT OUT to stop. You will receive one message confirming your opt-out and no further texts. STOP ends all texts from RentalFacts.online to that number. Reply START to resume.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • Our promotional texts never contain content about sex, hate speech, alcohol, firearms, tobacco or vaping, or cannabis.

Mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that support our services, such as the providers that deliver our messages. All other categories of sharing in this policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

9.5 Calls

We call using automated technology, or an artificial or AI-generated voice, only if you have turned on that voice channel. Every automated call identifies RentalFacts.online at the start and gives a callback number. We tell you when a voice is artificial or AI-generated. Promotional calls include a way to opt out during the call.

We make promotional calls and send promotional texts only during the hours federal law and the law of your state allow, based on your time zone. We check our internal do-not-call list, and we honor the National Do Not Call Registry and state do-not-call lists as the law requires.

9.6 Email

Every promotional email identifies RentalFacts.online, includes our postal address, and has a working unsubscribe link.

9.7 Changing your mind

You can withdraw consent by any reasonable means:

  • reply STOP to a text;
  • use an unsubscribe link;
  • change your account settings;
  • tell us during a call; or
  • email support@rentalfacts.online or call (844) 787-7799.

We honor opt-outs promptly, and in all cases within the time the law requires, currently no more than 10 business days.

9.8 Records and phone-number changes

We keep records of your consent choices, the disclosure you saw, timestamps, IP addresses, and opt-outs, so we can prove we followed the law (Section 11). Please update your phone number if it changes. We may check the FCC’s Reassigned Numbers Database so we do not contact someone who now has your old number.

10. Cookies, analytics, and Do Not Track

  • Cookies. We use one session cookie. It keeps you logged in and protects forms from cross-site request forgery. We do not use advertising cookies or third-party tracking pixels.
  • Analytics. Our analytics tool is self-hosted at analytics.rentalfacts.online. It does not use cookies, and its data is not shared with advertising networks.
  • Third parties that receive information when you visit:
    • Our pages load fonts from Google Fonts, so your browser sends your IP address and browser information to Google.
    • On payment pages, Stripe may collect device and browsing information to prevent fraud, under Stripe’s own privacy policy.
    Other than these, we do not allow third parties to collect personal information about your online activities over time and across different websites when you use the Service.
  • Do Not Track and Global Privacy Control. We do not track you across other websites, so we do not change our practices when your browser sends a Do Not Track signal. We treat a Global Privacy Control (GPC) signal as a request to opt out of the sale or sharing of your personal information. We do neither.

11. How long we keep information

InformationHow long we keep it
Listings, including content, media, and edit historyPermanently (Terms, Section 10)
Administrative communications with tenants, landlords, and advertisers, including removal, DMCA, and privacy requestsPermanently
Personal information tied to a listing (name, email, phone, address)Five years from the date the listing was submitted
Dispute materials (verification documents, ID images, responses)Five years from the date they were submitted
Consent and opt-out recordsAt least five years after your most recent choice
Payment recordsAs long as tax and accounting law requires, generally seven years
Server logsA limited period for security and troubleshooting, longer if needed to investigate abuse

At the end of a five-year period, we delete or de-identify the information. We keep it longer if it is still needed for a pending dispute, legal claim, legal hold, or legal obligation. Anything you chose to display publicly on a listing remains part of that listing. Intimate images removed under the TAKE IT DOWN Act, and other material the law requires us to destroy, are handled as described in Section 10 of our Terms.

Because these records protect tenants and the Service in legal disputes, we generally cannot delete them early on request (Section 12).

12. Your privacy rights and state-level disclosures

12.1 Rights we honor for every U.S. user

Many states give residents privacy rights, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. Whether or not a state law applies to us or to you, we honor these rights for all users in the United States:

  • Access and portability. Ask what personal information we have about you and get a copy in a portable format. You may also ask for a list of the specific third parties to which we have disclosed it.
  • Correction. Ask us to correct inaccurate information. You can update most account details and edit your listings yourself.
  • Deletion. Ask us to delete personal information. We will delete what we can, such as marketing preferences and account data not tied to a listing, dispute, or legal record. We may decline where the law provides an exception, including:
    • to protect free speech, yours or another user’s;
    • to establish, exercise, or defend legal claims;
    • to comply with a legal obligation; or
    • to protect security and prevent fraud.
    Because listing records and dispute materials serve as evidence, we will usually decline to delete them early. We will explain why.
  • Opting out of sale, sharing, targeted advertising, and profiling. We do none of these. We also honor GPC signals (Section 10).
  • Limiting use of sensitive information. We use sensitive information, such as ID images from disputes and any health details you choose to post, only to provide the Service, verify disputes, and comply with the law.
  • Withdrawing consent. You can change your communication choices at any time (Section 9).
  • No retaliation. We will not treat you differently for exercising these rights.

12.2 How to make a request

Email legal@rentalfacts.online with the subject line “Privacy Request,” or call us toll-free at (844) 787-7799.

  • Verification. We verify your identity by sending a one-time code to the email or phone on your account, and may ask for more information for sensitive requests. We use verification information only to verify you.
  • Authorized agents. An agent may make a request for you with your signed permission. We may confirm your identity with you directly.
  • Timing. We respond within 45 days, and may extend that once by up to 45 more days if we tell you why. Where a state law sets a shorter deadline, we follow it.
  • Appeals. If we decline your request, you may appeal by replying to our decision or emailing legal@rentalfacts.online with the subject line “Privacy Appeal.” We will respond in writing within 45 days. If you disagree with the result, you may contact your state Attorney General.

12.3 California

Within the past 12 months, we have collected these categories of personal information:

  • identifiers, such as name, email, phone, postal address, IP address, and account ID;
  • customer records, such as billing address and, for disputes, ID documents;
  • commercial information, such as packages and ad subscriptions purchased;
  • internet activity, such as logs and analytics;
  • approximate location derived from IP address;
  • audio, electronic, and visual information you upload;
  • professional information, such as company name and role; and
  • sensitive personal information, meaning ID images from disputers and any health details you choose to post.

We collected these from the sources in Section 2, for the purposes in Section 3. We disclosed them for business purposes only to the recipients in Section 6, and we keep them for the periods in Section 11. We have not sold or shared personal information, including that of consumers under 16. Under California’s “Shine the Light” law (Civil Code § 1798.83), we do not disclose personal information to third parties for their own direct marketing. This policy also serves as our disclosure under the California Online Privacy Protection Act.

12.4 Nevada

We collect the categories of covered information described in Section 2. We do not sell covered information as defined in NRS 603A.333. You may still submit a verified request directing us not to sell your covered information in the future, at our designated request address: legal@rentalfacts.online, or toll-free at (844) 787-7799. We will respond within 60 days. You may review and request changes to your information as described in Section 12.2. We explain how we notify you of material changes in Section 16. Whether third parties may collect information about your online activities over time and across websites is explained in Section 10. Nevada’s consumer health data law is addressed in Section 13.

13. Health information you choose to share

This section is our consumer health data privacy policy for purposes of Nevada law (NRS 603A, as amended by SB 370), Washington’s My Health My Data Act, and similar laws.

We do not ask for health information. Tenants sometimes describe how housing conditions such as mold, smoke, or pests have affected their health.

  • What we collect. Only what you choose to include in a listing, document, or message.
  • Source. You.
  • How we use it. To publish your listing as you direct, to moderate content, to respond to you, and to keep the records described in Section 11. We do not use it to identify or infer anyone’s health status.
  • Who receives it. The public, if you include it in a published listing, our service providers, and anyone described in Section 7. We never sell it.
  • Geofencing. We do not use geofencing around health care facilities or anywhere else.
  • Your rights. You may review, change, or ask us to delete this information using the process in Section 12.

If you include health information in a published listing, it becomes public. Consider leaving it out, and never include anyone else’s health information (Terms, Section 6).

14. Children

The Service is not directed to children. Accounts are for adults 18 and older. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it. Tell us at legal@rentalfacts.online if you believe a child has given us information. Identifying information about minors is not allowed in listings (Terms, Section 6).

15. Users outside the United States

The Service is about rental housing in the United States and is operated from the United States. If you use it from another country, your information will be transferred to, processed, and stored in the United States.

16. Changes to this policy

We may update this policy as the Service or the law changes, and will post the updated version with a new effective date. For material changes, we will notify account holders by email and post a notice on the Service before the change takes effect. We will not apply a material change to information we already hold without your consent where the law requires consent. We will never weaken the protections in Section 7 for information collected before the change.
